Governor's Executive Order Update

Dear Colleagues,

Last night the governor released his executive order (EO) regarding the LCAP and Physical Fitness requirements.  You can find the full text HERE.  

In summary:

  • Implementation of the new LCAP template is postponed until 2021/22.  
  • CDE will develop a proposed revised, significantly reduced LCAP template for the 2020/21 school year.  The deadline for adopting the 2020-21 plan is extended to December 15, 2020.  
  • In tandem with budget development, districts must develop a written report to the community that explains changes to the program offerings in response to COVID-19, which should include at minimum, a description of how the LEA is meeting the needs of unduplicated students in three specific areas: 1) Continue delivering high-quality distance learning; 2) providing school meals; and 3) Arranging for the supervision of students during school hours.  This report must be adopted during the same meeting at which the governing board of the LEA adopts the annual budget, due July 1, 2020.  CDE is developing a form districts may use for the report.  The budget and the report must be submitted to the County Office of Education.

Additionally there were important waivers that were granted to assist in the simplification of the LCAP process:

  • Removing the requirement that approval of the budget must include the adoption of the LCAP;
  • Suspending the requirement for data that is to be publicly reported for the Dashboard in conjunction with the adoption of the LCAP.  It is not clear yet if the deadline for local indicators is extended or if the requirement will be waived.

Finally, the EO waives the physical education instructional minutes and annual physical fitness tests.  

We will continue discussions regarding the LCAP at our weekly Tuesday meetings.  Over the next few days we will likely see additional guidance from CDE.  We will continue to push out information as it becomes available.  In the meantime, do not hesitate to reach out with any questions.
